These Product Terms govern your use of Methmine Browser: the Methmine desktop application, the Methium browser engine it runs, the Methmine account service, and the cloud, team and assistant features that come with them (together, the Software). They are a Product Schedule to the METHMINE Company Terms at https://methmine.com/legal/terms/ (the Company Terms), and together with the Company Terms, the Privacy Policy at https://methmine.com/legal/privacy/ and the Acceptable Use Policy at https://methmine.com/legal/acceptable-use/, they form one agreement between you and METHMINE LLC, a Wyoming limited liability company (Methmine, we, us).

Where these Product Terms and the Company Terms conflict on something specific to the Software, these Product Terms control. On governing law, dispute resolution, arbitration, limitation of liability, disclaimers and indemnity, the Company Terms control. On how personal data is handled, the Privacy Policy controls.

By creating an account, installing, or using the Software you accept this agreement. If you use the Software for an organisation, you accept it on that organisation's behalf and confirm you have authority to do so; "you" then means both you and the organisation.

1. Who may use the Software

1.1. You must be at least 18 years old and able to form a binding contract.

1.2. Access is by invitation or accepted application only. We may accept or refuse any application or invitation, and may limit the number of accounts, profiles or devices, at our discretion.

1.3. You may not use the Software if you are located in, ordinarily resident in, or acting for a person or entity in a country or region subject to comprehensive sanctions by the United States, or if you or the organisation you act for appear on a United States sanctions or export-restriction list, or if providing the Software to you would otherwise violate sanctions or export-control law applicable to us. You confirm this is true each time you use the Software. Section 11 applies.

2. The licence we grant you

2.1. Subject to this agreement, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and run the Software in object-code form on computers you own or control, for your own lawful purposes, during the term of this agreement.

2.2. The Software is licensed, not sold. We and our licensors keep all right, title and interest in the Software, including every copy, update, modification and derivative, and in the Methmine and Methium names and marks. No right is granted by implication or estoppel.

2.3. Open-source components. The Methium engine is built from the Chromium open-source project, and the Software includes other open-source components. Each of those components is licensed to you under its own licence, listed at https://methmine.com/legal/licenses/ and in the Software. Nothing in this agreement limits any right those licences give you in those components. The restrictions in Section 3 apply to everything else, including our own modifications, configuration, value store, fingerprint generator, account service and the application.

3. What you may not do

Except to the extent applicable law gives you a right that cannot be waived by contract, you may not, and may not help anyone else to:

  1. copy, modify, translate, or create derivative works of the Software, other than the open-source components under their own licences;
  2. decompile, disassemble, reverse engineer, or attempt to derive source code, algorithms, value tables or fingerprint data from the Software, or extract, analyse or reproduce how it generates or substitutes profile attributes;
  3. sell, rent, lease, lend, sublicense, resell, distribute, publish or make the Software available to anyone else, including as a hosted or managed service, or bundle it with another product;
  4. share, sell or transfer your account, an invitation, or access to the Software, except through the profile hand-over and team features the Software provides, and then only within this agreement;
  5. remove, alter or obscure any notice of ownership, licence or attribution;
  6. circumvent, disable or interfere with licensing, update, integrity, security or access-control features of the Software or of our services, or access our services by any means other than the Software;
  7. probe, scan or test the vulnerability of our services, or use them to send unsolicited messages, except under a written agreement with us;
  8. use the Software to build, train, benchmark or improve a competing product, or publish benchmarks or comparisons of the Software without our prior written consent;
  9. use the Software in breach of the Acceptable Use Policy or of any law.

4. Your account

4.1. You must give a working email address you control and keep your password confidential. You are responsible for everything done through your account and through every computer signed in to it, including by team members you admit and by assistant tools you connect (Section 7).

4.2. Tell us promptly at contact@methmine.com, with the subject "Security", if you believe your account or a computer signed in to it has been compromised.

4.3. Recovery. Account recovery depends on the recovery mechanisms described in the Software and in the Privacy Policy, including waiting periods that exist to protect you. We do not guarantee that a profile can be recovered if you lose your password, your recovery key, or the computer that holds a profile that was never copied to our cloud.

5. Your profiles and your data

5.1. On your computer. A profile, its cookies, saved passwords, site data, proxy settings and machine description live on your computer, encrypted by the Software. You are responsible for that computer, for backups, and for what you store in a profile.

5.2. Cloud copies. If you turn on the cloud for a profile, a sealed copy of the profile is stored on our servers and is available to every computer signed in to your account. The keys that open cloud copies are generated and held by us, under a cloud key-management service, and are released to computers signed in to your account. This means we are technically able to decrypt a cloud copy, including the live session cookies, saved passwords, proxy credentials and the device identity it contains. We do not access cloud copies except as described in the Privacy Policy. A cloud copy carries the profile's device identity, which does not expire the way a cookie does. Turn the cloud off for any profile you do not want held in this way.

5.3. Team profiles. If you share a profile with a team, the same applies: the profile is sealed under a team key that we generate and hold, it is available to every current member, and we are technically able to decrypt it. Removing a member stops new keys and new copies reaching them; it cannot take back what they already opened. We keep a 30-day history of who opened which shared profile and when. The team's owner is responsible for who they admit and for what members do with shared profiles.

5.4. Hand-over. Handing a profile to another account seals it under a code that travels outside our servers and carries no device identity. The recipient is responsible for the profile from the moment they accept it.

5.5. Licence to operate. You grant us a worldwide, non-exclusive, royalty-free licence to store, transmit and display your content to you and the people you choose, and to process it only as the Privacy Policy describes. No other rights in your content are granted, and you keep ownership of it. This is the licence in section 6.1 of the Company Terms, stated for the Software, and it is no wider.

5.6. You are responsible for your content. You confirm you have the right to store and use everything you put in a profile, including third-party accounts, cookies, passwords and proxy credentials, and that doing so does not breach any law or anyone else's rights.

5.7. Deletion. Deleting a profile on your computer is done in the Software and is under your control. Deleting a cloud or team copy removes it from our active storage at once; it remains in versioned storage and encrypted backups for up to 15 days and is then gone. See the Privacy Policy for every retention period.

6. Third-party websites, accounts and proxies

6.1. The Software lets you sign in to and act on websites and services run by others. Those websites and services have their own terms. You alone are responsible for complying with them, and for every account you create, hold, access or manage through the Software.

6.2. No outcome is promised. The Software presents each profile as a consistent, separate machine. We do not represent or warrant that any website, platform, anti-fraud or bot-detection system will accept, fail to link, fail to identify, or fail to restrict any profile, account or activity, or that any account will not be suspended, limited or closed. Websites change their checks without notice, and we have no control over them.

6.3. No anonymity guarantee. The Software does not make you anonymous. Your proxy or network provider, the websites you visit, and anyone with lawful authority over them may be able to identify you.

6.4. Proxies. Proxies, VPNs and network services you configure are provided by third parties under their own terms. We do not control them, are not responsible for them, and do not guarantee their performance, lawfulness or what they log. Proxy credentials you store are protected as described in the Privacy Policy.

6.5. Extensions. Browser extensions you install are third-party software. We may restrict what an extension can change in a profile, including its network settings, to protect the profile.

7. Assistant and automation features

7.1. The Software can let AI assistants and other programs on your computer act on your profiles through a local interface you turn on. Any action taken through that interface is an action taken by you.

7.2. An assistant can follow instructions it reads in a web page, a document or other content, including instructions written by someone hostile to you. You are solely responsible for which capabilities you enable, which assistants or programs you connect, and every action they take. Capabilities that can delete data, read cookies, change proxies or the device description, or sign in to accounts are off by default; turning any of them on is your decision and at your risk.

7.3. Automation through the Software remains subject to the Acceptable Use Policy and to the terms of the websites it acts on.

8. Updates, availability and beta status

8.1. Beta. The Software is in closed beta. It may contain errors, may change or lose features, and may be unavailable. Beta features are provided for evaluation and feedback.

8.2. Updates. The Software updates itself. Some updates are required: an older version may stop launching profiles or connecting to our services until it is updated, and a browser engine version may be retired. You consent to automatic download and installation of updates.

8.3. Changes and discontinuation. We may change, suspend or discontinue the Software, any feature, or any engine version at any time. Where reasonably possible we will give notice in the Software or by email. Profiles stored on your computer remain readable by the version of the Software you have.

8.4. No service level. Unless we have signed a separate service-level agreement with you, the account, cloud, team and update services are provided without any availability commitment.

9. Fees

9.1. During the closed beta the Software is provided without charge, unless we tell you otherwise in writing.

9.2. We may introduce paid plans. Before any charge, we will show you the price, the billing terms and any applicable refund and cancellation terms, and you will have to accept them. Free access during the beta does not create a right to free access later.

10. Feedback

If you send us suggestions, bug reports or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose without obligation to you.

11. Suspension and termination

11.1. You may stop using the Software at any time, and you may close your account by writing to contact@methmine.com from the account's email address, with the subject "Close my account".

11.2. We may suspend or terminate your account, revoke an invitation, disable cloud or team features, refuse updates, or end this agreement, with notice where that is reasonable and lawful, if we reasonably believe that you have breached this agreement or the Acceptable Use Policy, that your use exposes us or others to material legal or security risk, that we are required to by law or by a lawful order, or that continuing would violate sanctions or export-control law. We may also end this agreement for any other reason by giving you 30 days' notice. Where the law requires it, or where it is reasonable to do so, we will tell you why.

11.3. On termination your licence ends and you must stop using the Software. Profiles stored on your computer remain yours and readable there. We may delete cloud and team copies associated with a terminated account after the period stated in the Privacy Policy; download what you need before then.

11.4. Sections 2.2, 3, 5.5, 5.6, 6, 7, 10, 11.3, 12 and 13, and every provision of the Company Terms that by its nature survives, survive termination.

12. Export and sanctions

The Software contains encryption and is subject to United States export-control and sanctions law and to the laws of other countries. You will not export, re-export, transfer or provide access to the Software in violation of those laws, including to any person, country or region described in Section 1.3. We may block access from any location, without notice, to comply with them.

13. Disclaimer, liability and indemnity

The Software is provided "as is" and "as available". The disclaimers, the limitation of liability and your obligation to indemnify us are set out in the Company Terms and apply in full to the Software. Subject to the limits in Section 11 of the Company Terms, which this section does not override: you will defend, indemnify and hold harmless METHMINE LLC and its members, managers, employees and contractors from any claim, loss, penalty or expense, including reasonable legal fees, arising from your profiles and content, the accounts you access through the Software, your dealings with any website, platform or proxy provider, actions taken by assistants or programs you connect, or your breach of this agreement, the Acceptable Use Policy or any law.

14. Changes to these Product Terms

We may change these Product Terms. We will post the new version at https://methmine.com/legal/browser/ with a new date and, for material changes, tell you in the Software or by email at least 30 days before they take effect, unless a change is required by law or addresses security, fraud or abuse, in which case it may take effect sooner and we will still tell you. Changes to the Company Terms follow its section 7.2. If you do not accept a change, stop using the Software before it takes effect. Using the Software after that means you accept the change.
